Question

I own a one family home with my mother who is refusing to let me occupy an upstairs room, now rather than fight over a room i need ive decided that moving out is best for me and my daughter, now is there any abandonment law or penalty if i choose to relocate and stop paying my half of the mortgage and what are my options

this is my situation, i bought the house with my mom four years ago, i have a 2 year old daughter that is getting older and has a room upstairs, i reside in the basement with her but would like to occupy an ajoining room near hers but my mother refuses to move her items out of the room and i really hate arguing with her, its to the point that i rather leave my own property than deal with her.

Accepted Answer

If you are on the mortgage and do not pay the house will be in foreclosure and you will lose any equity due.

You are allowed to move out of a house even if you own it, that is not an issue, your mother however would be responsible for the entire amount of the mortgage, also she can sue you later for the entire property in a partition action, where she could claim the entire house for herself, due to her paying the full mortgage and expenses
