Not an Intellectual Property Law Question?
Question
We are a public school - non profit in every way - that produces dance performances that use pre-recorded music and live performance accompanied by our music department. These performances are part of our curriculum for our students. We make no money on them. Do we need to pay licensing fees to ASCAP BMI for the use of recorded and/or previously composed sheet music?

Answer
NO.
Generally, those who publicly perform music obtain permission from the owner of the music or his representative. However, there are a few limited exceptions, (called "exemptions") to this rule.
Performances as part of face to face teaching activity at a non-profit educational institutions are also exempt.
Permission is required when music is used as part of training seminars, conventions, or other commercial or business presentations.
