Question

there was a judgement against me from 1994 or 1996. Someone used my name to purchase a car and had an accident in which a judgement of 960.11 was placed on me. They also had a ticket which was dismissed. I have a copy of that, what is my alternative. Should I ask for the judgement be lowered or should I file a police report.

Optional Information

New Jersey

Already Tried:
I contacted the place of purchase for the vehicle and they responded by saying that there were no records of any transaction because the place was not an auto center it is now a auto parts business. I contacted the lawyer who represents the other and he stated that he will see if he can get the amount lowered. I went to the police station where the officer worked but they stated that he may have retired and they couldn't understand the signature on the paperwork. The report had my information on it everything was almost correct except for the birth year. Also, I wonder did this person show any identification because I had a picture driver license and the signature should have been different.

Answer

You should seek to vacate the judgment on the basis you are not liable and someone stole your identity and incurred this debt. If court wont grant it, sue the person who ran up this debt for full contribution.

the department of motor vehicle said that i didn't have enough information to claim identity theft

Accepted Answer

You can make a motion to a court of law to vacate the judgment or seek to have counsel negotiate a reduction on this basis and then pursue the primary debtor.
