i am from the caribbean and am being sued by a school, i have retained a lawyer twice in miami florida and requested that i meet him in person. He gave me all the reasons why i did not have to see him and got all my paper work. he has withdrawn himself because i wont pay him anymore money. my niece told me yesterday that she received a summons for me to attend court on the 11th tomorrow for deposition hearing. I can not be there what should i do

Answer

A deposition is like a mini-trial, except that it is informal. It is an opportunity for the other attorney to "discover" facts about the case by asking you questions. Not everything discussed during the deposition is necessarily admissible at trial. You are court ordered to attend, however, and a warrant can issue for your arrest if you refuse.

Unless you are unable to attend because of a medical emergency of some kind, you really should make an effort to attend. Otherwise, you should contact the person who summoned you (the other party's attorney) and the court, in writing and by phone if possible, and request that the deposition be rescheduled or dismissed (quashed). If you provide "good cause" as to why you should not have to appear, the other attorney or the court may not pursue sanctions against you.
