Question

my boyfriend recently purchesed a mobile home that he paid for in cash for us and our 4yr old son to live in. It is in his name only. Last month he was arrested and since he is on parole (california) he can not be bailed out. His sister came last night saying that he had signed a power of attorney and said that my son and I had to be out in 72hrs. I have been unable to communicate with him to find out if this is true. There is a rental agreement because of the space that the home sits on however I am not on that either. How can I find out if this power of attorney is real and even if it is wouldn't she have to go through the whole eveiction process and have me served with papers? I don't know what to do this will put me and my son in the street.

Answer

Thank you for contacting our JA team for guidance.

No. She cannot simply order you out on the street in 72 hours since this has been your home. You need to file a motion to enjoin her/him from evicting you without proper notice. You also need someone to assist you in doing this. Contact a legal aid office near you and explain your situation. If they cannot assist you right away, contact the state and local bar associations for referrals to someone who can.

Please let me know if you need additional information.

Best regards,
