Question
Last year I was sued by my landlord Borger management for allegedly not been paying my rent. Though I have been paying them on time and have the receipts to prove it. Though inconvenient for me, I went through the process of clearing my name, going to the bank, to court and have to give up my time to settle the dispute since they already sent me a court order. I even gave the copies of my checks.
Now just recently they again have sent me a court order for supposedly not paying the rent for the months March and April 09 without any kind of prior notice. Now i realized I have to go though that process again and the property manager even asked me to submit the last years reciepts which is now very inconvenient. I feel as if i have been taken for granted and my right as a tenant have been violated. Plus I work at night time and it only means i have to sacrifice my resting time just to take care of their mistake which they did to me twice already; since they dont want to go through their records since they say its easier for me to do it. I feel its so unfair. Pls advice me on this one.

no not at all. im always on time and not have problems. they just sued me 2x and it was their mistake and not want to take care of it.

Answer
You would need to file an answer denying the claim and asking for sanctions and court costs based on the frivolous nature of the lawsuit. Be sure to have proof of payments.

You can do it on your own but always best to have a lawyer handle it. He or she can file the answer and even move to dismiss or call the other side and convince them to withdraw it altogether but cost is a factor of course.
