Question

I got a divorce from my husband. He had to give me a settlement check and has to pay maintenance. On the settlement check in the memo he wrote ransom and on my maintenance checks in the memo each month he writes thief. Is there any thing I can do

If it is a repeated pattern of behavior it can be considered harassment. You can press charges for this and see if the police will handle it you can ask the police to at least talk to him to cease such conduct if you don't want to press charges.


Section 240.30 Aggravated harassment in the second degree.

A person is guilty of aggravated harassment in the second degree when, with intent to harass, annoy, threaten or alarm another person, he or she:

1. Either (a) communicates with a person, anonymously or otherwise by telephone, or by telegraph, mail or any other form of written communication, in a manner likely to cause annoyance or alarm; or (b) causes a communication to be initiated by mechanical or electronic means or otherwise, with a person, anonymously or otherwise, by telephone, or by telegraph, mail or any other form of written communication, in a manner likely to cause annoyance or alarm; or

2. Makes a telephone call, whether or not a conversation ensues, with no purpose of legitimate communication; or

3. Strikes, shoves, kicks, or otherwise subjects another person to physical contact, or attempts or threatens to do the same because of a belief or perception regarding such person's race, color, national origin, ancestry, gender, religion, religious practice, age, disability or sexual orientation, regardless of whether the belief or perception is correct; or

4. Commits the crime of harassment in the first degree and has previously been convicted of the crime of harassment in the first degree as defined by section 240.25 of this article within the preceding ten years.

Aggravated harassment in the second degree is a class A misdemeanor.

can I go after him for defermation of character

Answer

Defamation of character requires that the information be communicated to a third party and that as a result the third party acts adversely against you. Since the comments are directed to you (and not a third party) you have not met the other elements to sustain a defamation cause of action as there has been no publication to a third party nor adverse action against you because of what he said.

the bank tellers that see these checks are not considered third party?

They are a third party, but you then need to prove that the bank acted adversely against you (meaning they no longer wanted to work with you, because of what he said, as an example)
