Question

If a complaint is made about you to DOB about an illegal basement conversion and two previous attempts to access the property were missed do I really have to call and schedule an apt, or wait until they attempt again, or ignore it all together? Can they force their way in if the owner is not on property?

Answer

They can't force there way into the property. However, they can just file a lien against the property and not give their OK when you attempt to sell the property. then your stuck and will have to deal with it then. Better to do so now and get the matter resolved and not infuriate the powers that be and give them fuel to make your plight even worse.

We've spoken with two separate places that assure they can resolve the problem...one place said that we couldn't legalize it as a three family because it was only half brick construction and half frame, but we could legalize it as a duplex with the first floor and their fee was $8,000.00 with lifetime violation removal.
The other company assures us that it most certainly can be legalized as a three family but will cost us anywhere between $15,000 and $20,000. Does this sound correct? As a first time homeowner I have no idea who to trust and where to turn to.

I don't know what the problems are or what they would cost to fix. To be honest with you - your best bet might very well be talking to the municipalities building inspector who can give you great advice on the subject - they would certainly have a clue.

 

Most certainly I would ask around before I spent even $8,000.00 for a 3rd opinion.

 

Most certainly, I would talk to the building inspector and see what their opinion about what can be done and what can't be done. Get on his good side and correct the problems). Make the building inspector seem like an expert and stroke him some - he will become your friend in the matter and even help you.
