Question

what type of court Federal or State would handle an easement case if the easement is on the property of a citizen from Switzerland who has a busy in the same city as a develop. Can the non citizen sue me?

Nothing yet I just need to know what court would hear a case like this or if the non citizen has any legs to stand on the utility easement from found on a current development that was contracted me the city discovered the error and the owner of the property now there is talk of suing and shutting down the business.

The non-citizen can sue you in state court, since a property dispute is a state issue and the courts are not restricted to access only to US Citizens. Any person can file suit in the state courts without regards to their citizenship. If he owns the land and has a property dispute with you, he can sue for that dispute.

I haven't done anything yet what could possibly an outcome will the shut the business down and sue me for fraud if I did not know anything about the easement since it was a new project

If you did not know about the easement, the courts would simply craft a decision to make you pay for the easement or to find a way to enforce the easement rights. The utility easement would have to be enforced, so they can either force you to move the business off of the easement or pay to move the easement you have intereferred with.
