what do you mean, "they wont accept payments"?

yes. they can take it to small claims - but they should take your payments to get you up to date - and you should write them a letter explaining it and then if you need to go to court, you will be able to show that court you acted in good faith.

i am not sure what it is you are asking - can they take you to court, yes. do they need to accept payments - no. but a letter to them will show that they were not willing to work with you and jumped into litigation over the matter instead of trying to work with you based on your financial hardship. they certainly are entitled to their money - but if you write the letter and then go to court and present your efforts and an outline of your bills and income and payment plan, then the court MAY order them to work out a payment plan with you instead of allowing a full judgement
