Question

My husband was in the hospital a couple weeks ago because he fell down ours stairs and hit his head; he was feeling very dizzy and had a horrible headache. while he was in the hospital, he overheard the nurses talking about another lady's health information and he also heard them talking about his information in the hallway. He is now working with the legal department at the hospital to make a "settlement." What is a good number for this?

Answer

Hi

This is a challenging question, and there is not a definite answer.

If your husband's privacy rights were violated, you husband should recover for the damage caused by violation of those rights.

The settlement amount should be directly related to the amount of harm that was caused by the violation.

If no measurable damage has resulted, it may be difficult to ascertain the fair level of compensation.

However, you should know that the first offer is not usually the best and final offer.
