Question

My boyfriends mother was in a nursing home and we brought her home. While there they took $702 of her SSI. For this month she was there only four days and they sent her a bill for $586 Is this legal to charge her so much plus they also are billing medicare the full monthly amount

Answer

Hi XXXXXXXX,
They cannot accept double payment for services rendered. You have to check - if Medicare paid in full for the time she was there, she may be entitled to a refund of the $702 they took while she was there.

that does not fully answer my question. She normally paid $702 a month for the full month of her SSI and medicare paid an amount that I am not sure of. Now they are billing her $586 for only four days of care in April. The bill was not itemized so we do not know what the charges are for. It just seems to be a lot for 4 days when normally she paid $702 for the entire month. Thank you

Was this skilled care or personal care nursing? Have you asked for an itemization?

it was a skilled care nursing home and we did ask for an itemized bill but have not received one yet.

Do you have a copy of the contract for the nursing home - generally they do charge a monthly fee - not daily.

That's fine. The reason they charge monthly is to make sure they have their fixed costs covered.

The papers we have from the nursing home only states that on admission the fee has to be paid a month in advance. Nowhere does it say that you will have to pay for a full month on discharge.

Does it give a daily or monthly rate?

no according to the papers I read medical assistance determined the amount of her SSI minus deductions go to the home and medical assistance paid the balance but it does not tell me anywhere what that total is. I am so confused.

Answer

Usually, the person's stay at the nursing home is on a monthly basis - they don't work or operate like a hotel/motel on a daily basis.

Too, in review of your previos statements within your question, "The papers we have from the nursing home only states that on admission the fee has to be paid a month in advance." That would indicate to me that they are charging on a monthly basis as most nursing homes do. In fact, they could charge you for the whole month's term or the full $702.00.
