Recieved a refund from IRS of almost $5000 in tax year 2008 from an amended return tax year 2005, when I made an early withdrawal from a 401K plan. The amended return was filed because I was awarded a total disability in tax year 2007 retroactive to 2005. I recieved a 1099 on the interest $900, but nothing on the return of the tax overpayment. Is remainder not taxable?

Hello swedish,
The only time a tax refund is taxable is if you receive a refund of your state taxes in a year when you itemized your deductions.
Federal tax refunds are never taxable income to you. The only thing that would be taxable is the interest they paid you.
