Question

I was backing out of my parking space when a car came out of nowhere and stopped in a "No stopping any time" fire zone right behind. I hit the car, not hard, but left a dent in the side. We decided to not get insurance involved as the car I hit was worth less than my deductible. Now they want to go through insurance because I won't pay them a price higher than their car is worth. What are my options?

Optional Information

Collegeville, Pennsylvania

We have tried to negotiate without going through insurnce. I offered to pay $250, the cost of my deductible anyway, and the car is a 1992 Nissan Sentra worth around $600. The other driver got an estimate for $1,800 to fix the car. Will insurance even fix the car?

Accepted Answer

Hi,

You can either go through your insurance, which may deny their claim since it is debatable whether you are actually at fault or not, OR you can do nothing and wait until 1) they sue you to collect the money (again, you have a very good argument with regard to denying liability) or 2) they decide to accept what you are offering them.
