Question

I bought a new car about three weeks ago. Financed thru the dealership at 0% and no down payment. 14 days after they called and convinced me to come down under false pretences and then told me they couldn't get me financed (Im in vegas I know they have 15 days to recind it). I then had my dad sign for the car under the same deal. There now saying they can't get him financed and they wan't the car back.   My two questions are: Do I have to bring the car back to them or can I make them pick it up? And when they did the contract with my dad they kept the same date that I signed on so technically according to the paper work they missed there 15 day window. So does the deal stand or does that the fact that it had only been a few days since he signed apply.

The notice to cancel would have to be within the 15 day window. So if you are saying that they took the existing contract they had with you to transact with dad, then they are bound to that existing contract and deadline. If they failed to cancel within the 15 day then your dad would have grounds to refuse the return. So make sure that is what the contract says. Any payments would have to be directed to the dealer despite the fact that they have failed to find approved financing.

Now if you wish to cancel the whole deal anyways, they can be made responsible to pick up the car. You are not required to drive it over there unless the contract terms specifically provide you would be responsible for its return.
