Can a military spouse get in trouble for slander under the uscmj? <br /> <br />Can her husband be charged for "failure to control dependents"?

A spouse, who is not in the military, is NOT subject to the UCMJ. So there is not any method to charge the spouse under military law.

Now, for the member husband...it may be possible to charge for failure to control if it can be tied to a detrimental effect on the command or the service...but this is difficult to do and if the command attempts this your husband should seek legal advice from JAG. Such a charge is difficult to draft and to prove...so if the command attempts this, it would be good to get legal advice prior to making any decisions on how to deal with such a charge.
