Question

i took my daughter to chicago, to start college. once we got there to the rental office of this loft. there was a sign agreement with my name on it. i told the representor that i didn't remember signing a contract. i ask for a copy, she didn't give it to me. she said she fax a blank agreement to my husband office, and it was fax back to her sign. i ask my husband did he sign my name, he said no. now, they are sueing me for none payments. what can i do?

i've tried talking to the sueing attorney. i've mail photo copies of mines, my husband and my daughter signture on the driver license.the attorney said he did not beleive my explanation.

i'm being sued for 11 payments. my daughter live there for 1.5 month. i never seen the contract until the sueing attorney mail it o me this month and it is not my signture on it. my husband and i didn't live together, so i ask him about th signtures on the contract. so the loft is suing me because they said i was the co-signer with my daughter. my daughter have a 12 month rental lease.

Thank you for your clarification.

Since you are being sued, your best bet is to respond to the lawsuit by filing documentation setting forth your defense that you never entered into a contract and that the signature on the contract is not yours. Ultimately, the trier of fact will have the ability to review the document to make the determination as to whether they believe that you signed the document. In the event that you can prove the signature is not yours, you should be able to have the lawsuit dismissed against you.
