Question

I was a victim of identity theft. Over 25 apps filled out by my neighbors and I'm still getting bills in the mail after notifying the CC companies. I was in the hospital for a week and did not make some of the deadlines to have the cards voided. One woman is in jail and the other is handicapped and was not prosecuted. I probably can't get blood from a stone from tese two, is there any way to collect from the CC companies for time spent, etc?

Optional Information

Syracuse, New York

Already Tried:
I've notified most of the companies, and closed most of the accounts, my credit score, so sayeth them should go back up when all have been resolved. I will notify the companies that I have lapsed over their deadline for complaint (due to hospital stay). I am an Iraq war veteran, is there any support from the VA that you know of?

Accepted Answer

You really cannot sue the CC company, since they too were defrauded and victimized on this matter. Unfortunately, the bad part of these matters is that they can take years to straighen out and the best way to make the process move more smoothly is by hiring a consumer protection law attorney to send out the notices to the CC companies and the credit bureaus to adjust your credit score and note the fraud on your credit report. This is a frustrating process to work through. Even if you did not meet the deadlines, if your identity was stolen, then the time frames set by the companies are not realistic and they are trying to make you pay their losses and you are not responsible for these losses. This is another area where the attorney will be able to stop the CC companies from trying to make you bear the burden of their losses.
