Unfortunately, a company can take a person to court if they have fallen behind on a debt. Quite often companies will make arrangements to pay the debt back however if they fall behind at all on these arrangements or if they are late ever, many times the company will revoke this arrangement and pursue further legal action such as taking a person to court. Quite often a creditor does not have to accept a payment which is les than the full payment or if there is a default on the loan, the creditor does not have to agree to a payment plan.
