Question

I have a son incarcerated in Illinois for robbery and his tenative discharge date is 10/2010. He is also charged with probation violation in Georgia due to his current conviction in Illinois. Is it possible to have a Georgia attorney motion up his probation violation for disposition and if additional time is handed down, allow the additional time to be served concurrently with the Illinois time? If so, what price range could be expected for the Georgia attorney's fee.

I am an attorney in Illinois. I know the Country Club Hills area very well. I also teach law at Northern Illinois University College of Law. I believe you need an Illinois Attorney to coordinate with Georgia, in order for the disposition to take place in Georgia, and then ask for the time to be served in Illinois. However, I have to tell you that the prosecutors in Georgia would have to have a written agreement with Illinois to serve the time in Illinois. The two states are two different jurisdictions. Normally, Georgia would have the right to ask Illinois to extradite your son to Georgia, after his time is served in Illinois. If you want to keep it in Illinois, you need an Illinois attorney to help with the coordination to have the Georgia time served in Illinois. I hope that this has been helpful.
