Question

How do I Petition the probate court (Cook County, IL)for an accounting of a living trust. I'm a beneficiary in the trust but the trustee is being evasive and possibly criminal in the trust's resolution.

Already Tried:
This has been an on going 2 and 1/2 year of pulling teeth to get any information from the trustee. Resolution has been promised three times over the last six months with no resolution. I recently found out that the house in the trust was quick claimed deeded to the trustee's mother. I think the estate might be worth 500K
and I'm listed for only 2%. The trustee has been very evasive and I just want this to come to a head.

Answer

You need to hire an attorney is the first thing. The next thing, because of the self dealing, you would file a suit against the trustee for breach of fiduciary duty and in that action you would seek a complete accounting of the trust. The thing with trusts is the reason people set them up is to keep their financial matters out of the probate court, so your action would be a suit against the trustee for breach of duty to the trust.
