Question

We wrote a motion on our own to the judge on the case and the response was that the motion was stricken due to legal nullity and upon review of the file the defendant is being represented by the Public Deffender's Office. The state has not issued a PD as I have not made my first arraignment appearance and they stated: thompson vs State (615so2d737 Fla 1ST DCA 1993), Johnson vs State (401 SO 2D 94 FLA 1ST DCA 1987), Salser vs State (582 so 2d 12 fla 5th dca1991)Mourra vs State (29 fla l weekly d226 2nd dca july 2 2004), what does all this?

It means the motion you made was rejected because there is no way the court can legally grant what ever it was that you requested in the motion. Also that since you're being represented by the PD office that the PD office is the person/attorney who should have filed the motion because it's not proper for the court to entertain papers or comments from a person who is represented by an attorney. The cases cites are cases used to support the decision made by the court. You can obtain copies of the cases from either your local public legal library or local law school library.
