Question

My step-mother passed away in Dallas Tx Jan 8 2009. I am the beneficiary of my father's trust that was in her name until her death. The trust company that manages the trust needs a death certificate and the naming of the executor of the will before they can terminate the trust in my step-mother's name and transfer it to me. How can get a copy of the death certificate and a copy of the probate courts naming of the executor of her will.? I have searched probate records on line and not found anything. I think I can apply for a copy of the death certificate as I am a beneficiary.

Answer

You should be able to get the death cetificate from the funeral home. That is the standard procedure. Someone will have to file to open probate and be named the personal representative. No one does this for you. If she has blood relatives, they will be first in line to be named PR but there is no reason you can't file.

I have no idea what the funeral home was. The step-mo's family notified the Trust Co of the death. That is all. So how do I get the death certificate?\

I know they have to file in probate to be named. Her daughter who had power of attorney will most likely file. Why would I file?

You would file because the Trust Co says someone has to in order for you to get your money. I don't have a crystal ball and had no idea of any other relatives. Check the obituitaries. The local paper is usually online and it will list the funeral home.

The obit does not say what funeral home handled the funeral.
So, again how do I get the legal copy of the death certificate?

You can check with vital records but they may not have it entered yet. Here it takes about 6 weeks for processing.

Ok, one last question.
How do I file with the probate court? What is the name of the form?? Do I file just as the beneficiary of the trust?
I am sure the daughter will file as executor.

I don't see why this question is difficult. You told me earlier that I could file in probate but I am asking you how to do that if someone else is filing as executor.\
