Question

I am suing GMAC Mortgage for Defamation(Libel), Unfair/Deceptive Collection Practices, False Documentation, Harassment, and Unfair Tax Collections all of which I have proof evidence to show neglegence on their part, along with requesting unlimited damages. I am going pro-per because I am on disability and would have to pay in payments which no one is willing to accept. I would like to know what forms (form #'s) are required in order to request a hearing. This case is bigger than small claims. I am a Veteran, this was under a V.A. type loan with an Impound Account that was and still is established and current. There were several investigations initiated by the Dept. of Veterans Affairs, FBI, Dept. of Corporations, Consumer Affairs, Dept. of Civil Rights Affairs among others, in which I have documentations showing neglegance on there part. How do I get help (paralegal) or attorney who is willing to go on pro-bono or accept installments?

Optional Information

Fontana, California

Already Tried:
I've tried calling and talking to supervisors in their corporate offices at their headquarters branch among other locations, writing to them and receiving negative responses, I'd receive document threats over the months, and GMAC would over charge me by stating "you have an escrow shortage" but not realizing that I have proof showing the opposite.

Finally, being told by two attorneys that in the State of California once I prove Defamation of Character, I am entitled to half their total net value. They said that I definitely have proven it I just have to bring them in.
Finances have made it difficult and with how GMAC have destroyed my credit with false derrogatories, I cannot refinance, request a modification, or attempt to take out any portion of my equity, in which I have never taking out anything from my house in 13 years. I just don't exist as far as the world is concerned whenever they look at the credit reports regardless of all the proof I have. They would say once everything is cleared up then re-call us back.

The following site provides links to various free legal aid centers where you can consult with an attorney regarding taking your case pro bono, there are location in pomona and riverside, among others: http://www.usattorneylegalservices.com/free-legal-aid-california.html. If they cannot assist you then they should be able to point you to someone who can.

Some law schools also have free legal clinics that may be able to assist you such as UCLA (http://www.templeisaiah.com/sunday-free-legal-clinic ) and USC (http://law.usc.edu/academics/clinical/sbc.cfm)

Im not sure if you have filed suit yet, and in what court, but hearings usually occur after filing suit and usually relate to a motion that has been filed, i.e. a motion to dismiss, motin to compel documents, motion for summary judgment etc.. Hearings are not requested by filling out a form, but by requesting them in a motion before the court (either orally before the judge and/or in a written motion). In other words, the hearing must relate to a particular issue that is before the court in a motion. The court you file in will have a website with its own "local rules" and any forms that you need to follow, state court is very different from federal, an each court has its own local and judge-amde ruels so you have to go to the specific court's website AND also check on the website for your judge and and personal rules he/she has for her courtroom. best of luck
