on a small claims pre trial conference
the judge took the case after a conference was unsuccessful, and wrote a decission of not triable. this is a breach of contract, how can the judge not state reasons. ?

I am not clear here. Are you the plaintiff or defendant? The case has to have an outcome if the sides cant settle. what is the judge directing the sides to do?

<p>I am plaintiff, judge rule 7.135 "there is no triable issue" "the plaintiff shall take nothing</p><p>by this action, and defendant shall go hence without dealay "</p>

The court can dismiss your claim if it finds no triable issue of fact. If that happened here, you would need to appeal.

One word of caution though. Appeals, even at the small claims level, can often cost in legal fees more than what the case is worth, so consider if you can work out a settlement with the defendant on the promise that otherwise an appeal would be filed.
