Question

When I was 18 Dr.G did surgery that was 100%un-necessary,I did not request,& I did not consent to(mother signed;we both thought he was fixing my nose);essentially destroying my face including nerve damage, eye problems,etc. Dr.G then did several major surgeries to repair some of his damage without success(lying to me the entire time). LaterDr.B.-major facial reconstruction&Dr.S. also tried to repair some of Dr.G damage.Because of Dr.G I will always require future surgery.It's difficult being deformed only because a surgeon wanted to do a surgery for his own personal reasons.I recently read and finally understand(now that I'm very educated)all of my prior OR reports& recently discovered Dr.G should never have done a midface advancement on me(broke my face, moved it forward,and my face fell apart)! Because I just discovered Dr.G lied to me when I was young&uneducated& what he did was wrong, un-necessary,& severely harmed me, do I have a lawsuit? Medical Malpractice or criminal?Next step?

Dr. Guyuron practices in Cleveland OH. Legally, I've tried nothing. Dr. Guyuron found me by soliciting patients from local plastic surgeons (I was born with a cleft lip and palate, leaving the left side of my nose slightly flat and asymmetrical, just my nose). Dr. Guyuron made me believe for years that I just didn't respond well to his surgery. I always thought I was the problem. Recently I had more facial surgery (to again try to correct some of Dr. G's damage); thus, I got out and read all the previous OR records. Now that I am an Anesthesiologist I can easily understand my records. I was shocked to learn what Dr. G. did to me; especially as I examined my photos prior to him destroying my face. The problem is that Dr. G performed these surgeries in 1981 - 1983. I didn't bring a lawsuit back then because I never understood what he did or why; I just knew I responded poorly to surgery. Now I clearly know that what he did to me was 100% un-necessary, inappropriate, he did it very poorly, and covered it up by lying to me and misleading me. I have always tried to go forward, and not look back; but it was really hard as I hated what I saw in the mirror, and in the eyes of others (Dr. Guyuron made a nice looking young lady into a "grossly deformed" (per Dr. Byrd's OR report) woman. I believe that's criminal! Unfortunately, because I have learned the truth so late, I'm afraid there is nothing I can do. Any advice?

45 years old! When I was 18yo Dr. Guyuron did not explain what he was doing to me; I did not sign the consent. I just found out 2 months ago that Dr. Guyuron lied and midled me.

I wanted a legal expert in medical malpractice. The lawyer I said yes to was someone other than you. How do I know I'm getting advice by an expert in this field?

Hello and thanks so much for choosing this forum to pose your important legal question. I will do my best to give you some honest and accurate guidance as I answer your question.

 

  1. I am a licensed attorney, and I will be glad to try and answer your question. I hope that the following information will be helpful to you, but please just write back if you have any follow-up questions or need clarification on anything after reviewing the following information. Thank you for taking the time to write back and supply the additional requested information, which was helpful to my analysis of your inquiry. I am sorry for all you have been through, and I hope that everything gets resolved appropriately in this situation. I am afraid that I do not have encouraging news to share with you.
  2. Unfortunately, medical malpractice claimants must bring a civil suit within three years from the date of the occurrence or the date when the occurrence should have been discovered, but in no case more than six years from the date of the occurrence. S.C. Code Ann. § 15-3-545. The statute of limitations is tolled during the claimant's minority; however, the period may not extend beyond seven years from the date of the occurrence, or more than one year after the child attains the age of majority, whichever period is shorter. The statute is also tolled during a claimant's insanity, but the tolling period cannot extend more than five years from the date of the occurrence or one year beyond the date the disability ceases.. S.C. Code Ann. § 15-3-40.
  3. However, although a civil action is time-barred, there are two avenues open to you for seeking action on this matter. From the criminal standpoint, South Carolina has no statute of limitation on any crime except writing bad checks. This puts South Carolina in the four strictest states, in regard to statutes of limitations. Given that you did not consent to the surgical procedure, the appropriate action would be to contact your local law enforcement authorities and request to file a criminal complaint alleging assault. The other step you can take is to file a complaint with the South Carolina Board of Medical Examiners.
  4. Regarding your mention of a different lawyer being involved, I must admit I am not sure what you mean here. My screen only shows myself as an involved legal expert, but I will be glad to share my qualifications with you. I have been a registered nurse for 19 years and a licensed attorney for 13 years. I was awarded the Corpus Juris Secundum award for the highest grade (100%) in Torts during law school. I also graduated with high distinction with a ranking of second in my class at nursing school (grade point average of almost 4.0). I have worked as an attorney on both sides of the medical malpractice docket (plaintiff and defense). I thought I would have to apply to the Ohio board of Medical Examiners since Dr. Guyuron is in Ohio; but you recommend South Carolina?

Please allow me to apologize for any confusion. Once in a while I am unable to see the information listed under "Already Tried". I now see exactly what you mean by you mention that he practices in Cleveland. You would indeed need to contact the State Medical Board of Ohio to file a complaint.
