my landlord renew a lease every 12 months, but it is just a type written letter stating that if i want to sign the lease for the next 12 months i must pay $745 per month (every year, the rent is raised about $30) starting from Sept.1 09. I did not sign anything for this year lease, but started paying requested amount starting on the requested day. If I decide to move, will it be breach of contract?

Answer

If you didn't sign the contract, you're in a month to month lease with the landlord, and you can cancel the lease without penalty with 30 days notice.

The landlord may claim you have a 1 year lease, but unless your name is on a contract, you're month to month.
