Question

My sales bonus plan's eligibility requirements state "Associates who are terminated by the company during or after the completion of the performance period, but before issuance of a bonus check, will forfeit bonus unless dictated otherwise by state or local laws." What are the Georgia labor laws concerning this issue?

The federal law is more strict than Georgia laws and I could find no Georgia law on point; thus, unfortunately, since federal law does not forbid this practice, and since Georgia law does not forbid this practice, that I could find, this would be legal in GA.

You have the option of filing a complaint with the Georgia Labor Dept. in order to try to recover your bonus using an allegation that they were earned wages. Best wishes.
