Can a creditor come after me for difference in sale price and what I owed on debt if I voluntarily surrendered property.     This concerns an automobile and a home mortgage. I am in Texas.

Nothing but losing my house is imminent and want to get rid of motorcycle loan too. I do not want to keep house as I have another with much equity I have moved into. The more expensive home I have no equity in and have tried to sell but in today's economy I can't get what I owe. no job just trying to survive.

Yes, for both a home mortgage and a motor vehicle, the creditor can obtain a deficiency judgment for the difference between fair market value on the date of sale, and the value of the underlying loans.
