Question

I am deaf and reside in the State of Texas. I need someone to represent me for a case of Discrimination, Harassment, Retaliation, Workers Comp, Wrongful Termination, Defamation of Character, ASSAULT, LIBEL & SLANDER, intentional infliction of emotional & financial distress, etc. To make a long story short, I have worked there for over 3 years. I have asked for accommodations and they were not provided. I have been told I have selective hearing, told to read my lips. I have tried to speak with management and the problems do not get resolved. I have been physically pushed and they did nothing. I have a work related injury which I am getting denied Physical Therapy and Surgery for. I have received a "right to sue" letter from EEOC. I am getting denied workers unemployment benefits. The EEOC nor TWC investigated nor provided transcripts for audio evidence. I have all ready filed the compliant with the UNTIED STATES DISTRICT COURT WESTERN DISTRICT OF TEXAS been denied appointment of counsel

I am broke and have no money to even pay to answer these questions. Maybe we can answer these on contingency or other basis. I have been denied request for appointment of counsel despite my disability and my incomprehension of said processes and procedures. I am completely broke on food stamps and have been unable to get reemployment anywhere. Some applications require me to sign for a complete background check and to release my prior employer from liability which I can not sign due to the law suite. I will allow criminal background checks but most employers do not need complete background checks which are including financial, medical and more. Most employers are not secure enough to even handle the full report which leads to identity thief. Employers that are requiring the full report will not let me turn in an application for employment. Just to mention a few issues. I have tried many organizations like Advocacy Inc., Legal Aid, TX Civil Rights Project, National Association of the Deaf (NAD), U.T. School of Law, etc. just to name a few places which has denied me due to limited budgets, inability to handle fee-generating cases, etc. The Adocacy Inc. is refusing to assist me with my case claiming they no longer have an attorney to handle my case. The State Bar of Texas has a PDF file called "Basic Facts about the Deaf & Their Lawyers.pdf" on their website to give general information: http://www.texasbar.com/Content/NavigationMenu/Other_Services/Attorney_Member_Services/Sign_Up_Fund1/What_is_the_Sign-Up_Fund_.htm. Please let me know what you think any details should be discussed in a secure enviroment.

Answer

Hello, you have been really savvy to move this far without an attorney. If you have been denied an disability accommodation and the employer did not grant you such then you may challenge but you would need to show that the accommodation did not create a hardship. Now you would need to show how the employer could have accommodated your disability. Since you have a Right To Sue Letter you should locate an employment attorney to take the case on contingency fee. Ensure you do before the statute limitation. You may do better with a small law office.
