Question

I was an independent contractor for a roofing company in 2008. I have not been paid for many projects that have been completed. I also have a number of contracts that are in the process of being completed, can I file liens on those properties in order to be paid by the general contractor.

Info Request

Good morning,

Are you a licensed contractor who acted as a sub-contractor on the project?

I'll put forth my best effort in assisting you. When you are able to respond to my request for clarification of your situation, I'll be able to assist you. In the meantime I would ask that you please stay on-line, just in case I need additional clarification from you regarding the factual circumstances relating to your question. Thank you for allowing me to help.

Regards,

Doug

A license is not required for salesperson. I was hired by the roofing company as an independent contractor. I would sell the job and recieve 35% of the profits.

Answer

Good morning,

You are of course correct regarding your need for a contractor's license.

As a salesman, you are not eligible to place a mechanics lien on a home by reason of having secured the contract for the work.

I'm afraid to be eligible to file such a lien you need to be either the contractor that supplied the labor, or the material supplier.

Your only recourse is to sue the roofing company for breach of contract to collect what is owed to you.

I wish you the best in obtaining the compensation owed you.

Thank you very much for having allowed me to assist you. It would be greatly appreciated if you would click the green Accept icon so that I can receive credit for having assisted you.

Best regards,

Doug
