Question

I moved my wife and daughter to Virginia Beach Va from Pittsburgh Pa in May 2008 for a permanant position as a Project manager in a commercial floor covering firm. Two people in an unprotected class were hired after me. I was dismissed in November 2008 for performance reasons. The sale figures that I had accrued show that I was the second most productive sale person within a company that employees more than 15 but less than 100 employees. These actions have ruined my life both financially and emotionally. Is there a general rule of thumb as to what this case is worth? My mediation with the EEOC is 3-31-09.

I have filed a complaint with the EEOC in Norfolk Va. I have a scheduled mediation with my former employer on 3031-09. I have been unable to find employment in this economy and am unable to sell my hous, which I will soon lose. I am 61 years old. A 45 year old woman and a 31 year old man were hired to take my position. I was paid $60K/year a 40% cut in pay to take this position. The people who replaced me made $40K /yr. I can get no attorney who is willing to take my case. I have 300 pages of doctuments to support my case.

Answer

No there is no general amount. You would need to add up the cost of your move and the loss of income and benefits and any attorney fees you have to pay, to get your specific amount you can sue for.
