Question

I have a reprimand in my personnel file. I work for a Colorado County Governmental Agency. I have been told that this reprimand cannot be removed from the file, as it is part of "The Permanent Record". Is this true under Colorado Labor Law. I am noticing that in other states (California, for example) a reprimand can be removed after a certain period of time has passed.

Under the CO public records laws, they cannot purge your employee records, but you are entitled to inspect them and can prepare a written response to anything in the file you disagree with to have included in the file. There is no law in CO authorizing the removal of items from the files and thus the employer cannot just remove items from the files absent any law or ordinance or rule or contractual provision to the contrary.
