Question

I live in Sweeny TX, and live in an apartment complex called Canterbury Squares. I have lived here for 6 years. This complex has been here for 30 years, and during that time it has been an excepted practice to have satelite dishes, that we purchase, for our TVs. New management has taken over, and we've been told that they want them down at our expence, and that they will basicly not allow us to have satelite TV, but can purchase their cable. Now I have a HD dish and TV, and they do not provide this service. Since no law is being violated, and these dishes have been here for years, and we have lots of money tied up in them, can they just take them down without our permission and leave us to deal with it.    John M. I rent, and there is nothing in my contract that states that I can't have a satelite dish. Ths is just something that the new owner has come up with, and says we can't do anything about it, he just wants them down, and he will take them down. I think that it is tampering with private property, with no recourse for me.

Answer

If that contract or lease is in effect you can rightly argue that the landlord/new management cannot impose new conditions or removals until the lease term ends.

The landlord says that no where in the contract does it say I can have a dish, but it is obvious that it has been excepted, because there are dishes on many units, I'm not the only one. What can I do to stop this

1. it does not say you cant have one
2. assuming there is such an implicit rule, it has been waived and not enforced.
