Question

My sons mother filed a motion for temparary order to get full costudy of our son and not let me have any visitation rights. I submitted a costudy and compliante for to get Joint-Costudy, should I be worried of not being able to see my son again if I keep asking for joint costudy?

I filed to get joint costudy of our son before the mother did. After she was served by a constable she went and filed also for a motion for temporary order.

Regardless of how the custody matter is resolved so long as youre not a danger to the child then you should have at the very least visitation with the child regardless of what the mother wishes. If you believe the child would be best served by joint custody then dont give up or even seek sole custody if you believe the mother will attempt to prevent you from seeing the child.

She has a restraining order against me for 1 year, and the motion she lied and stayed that I was going to hit my son. Does that affect my rights?

Answer

Courts will generally separate any issues the parents have from the children. You should still receive at least visitation with the child.
