My 84-year-old mother lives in Georgia who has a third grade education and is somewhat illiterate wanted to help her 43-year old grandson buy his first home. She thought she was co-signing a loan with him but instead he had her sign a quit claim deed which signed her house completely over to him. She was not given a copy of what she signed and she had no idea that is what he was doing. What recourse does she have in getting her deed back to her home?

Nothing yet just found out about this situation and not sure how to handle. Mother is very distraught that grandson has already deeded her home in his name.

Accepted Answer

You would have to sue the grandson based upon Fraud to help your mother regain title to the house. You have to prove that she was not award of what she was doing and the fact that she is illiterate to the extent she could not have formed the legal intent to knowing transfer title the house. You need to do this quick before the grandson does something to affect the property or cause it to be transfered to another person.

Answer

She would have to sue him but you could help her with the process. The only way you could sue for her is if you had Power Of Attorney or was appointed as her Guardian by a court.
