Question

Property location: Louisville Kentucky. I have a property management company handling the leasing of my property. They collected a security deposit on a signed 15month lease (non-certified form ??? really) and allow tenant to take possesion of my property. The check was returned and the tenant is still there! They have been in my property for three months and no rent has been collect! Now it appears that the "actual eviction" process has started but how do i protect myself from abandonment of this tenant i know nothing about? Can i collect rent for the 15 month term (or 3months plus any abandoment fees stated in lease agreement)? Can i go after the property management company for negligence and fiduciary responsibility to me the principal (owner)?

1. Deposited the check timely
2. Initiated the eviction timely
3. Ran a credit check on the prospective tenant
4. Filed a police report on the NSF check
