My sister in law just past away leaving no "legal" Gaurdian. My 13 year old nephew lives with his grandmother. He and his Mom always have. Grandmother is 76 years old. No one wants to remove him from his Grandmother but we want to know if we should go for Guardianship or custody in case Grandma passes away before he reaches legal age.

You may want to file for guardianship. She probably will be unable to hanlde him in a couple of years. If he is to receive anything from her estate, someone will need to manage his money so you may also want to get a conservatorship.
