Question

I have to attend a civil deposition. They are requesting me to bring financial records of my income and assets. This was a law suit won against me for failing to close on a real estate purchase here in florida. They got a civil judgement against me. Now that want me to produce these financial records in order for me to pay. I dont want to produce these records. Can I just show up to the depo and plead the fifth amendment on all my testimony?

I have not shown up to a previous dpo in August and now that I have to show up to this one on Wed...if not I will be in contempt.

Answer

Unfortunately no. Once the judgment has been obtained against you, they are just looking for assets to take. If you don't show the documents, then the judge can hold you in contempt and can make you disclose the documents or even sanction you so that you owe more money. Your best option would be to check your state's exemptions since there are many types of assets that a judgment creditor is not permitted to take according to your state's laws.
