Question

I am slightly handicapped and I live in an apt. complex with a handicap ramp with NO railings and a fairly long walkway with one step to get to the entrance of the apt from the car. The apts are about 2-3 years old in Gloucester Twp, NJ. I have falled 3 times so far. Twice there were no witnesses and once on Sunday 2/15/09 a lady helped me to get up. I can hardly get up bc there is nothing to hold onto to get up. I am sore and have bruises and a skinned knee but no broken bones. I want to contact the building codes dept. to ask about the regulations for railings. Building A has a handicap ramp railing and one at one of the enterances to the apts. I live in Bldg. B and there are no railings. Can I do anything about this?

Answer

You should write your landlord and advise them that you would like them to make reasonable accommodations for you in light of the fact that you have now fallen three times. Make sure you advise what you think reasonable accommodations are.

If they fail to respond, get in touch with a good employment lawyer as they understand the Americans with Disabilities Act. (ADA).

I hope this helps.

Ron
