Answer

The cover caption page and signature pages do not count for the page limit, so its really only the actual text/body of the brief that count. I can you please clarify what you mean by the "15 guides"?

15 guides are the instructions for completely the forms .

I: motion for leave to proceed in forma pauperis

II. Affidavid or declaratioin for leave to proceed in forma pauperis

lll. Cover Page

iv Questions Presented

V List of Parties

VI Table of Contents

VII Index of Appendices

VIII Table of Authorities

IX Opinions Below

X Jurisdiction

XIConstitutionbal and Statutory Provisions Involved

XII Statement of the Case

XIII Reasons for Granting the Petition

XIV Conclusion

XV Proof of Service

Where in this does the 40 pages start counting? What would be considered page one, my instructions says "IX Opinions Below" starts the 40 pages. But where does the writ of certiorari come in at?

Where would the table of authorities go?

Does the federal authorities and Virginia authorites need to be seperated?

Accepted Answer

yes that's right, as you can see from this sample http://www.internationaljusticeproject.org/pdfs/atkinsUSSCbriefRobLee.pdf

the first page starts at the "opinions below" section.

Also, here is another sample petition for writ of cert, this one has an intro before the "opinions below" section so the first page starts with the intro: http://www.spamsuite.com/webfm_send/410

As seen in the samples, the table of authorities is placed right after the table of contents. The entire brief is the petition for writ of certiori. best of luck

Alex, I did your payment and certainly appreciate all your help. There is one other thing I need to know. I have exhibits I need to send and an index of exhibits. Where do I put these? Sincerely appreciate any help

Accepted Answer

Yes put the exhibits in order at the end after everything, include a slip sheet (a blank sheet of paper stating "Exhibit A" in the center in large bold face before every exhibit).
