Question

I co-signed for my son’s student loan. He went to school for only three months. He gave the school ten thousand dollars right of the bat. My son was reimbursement to fallow up with his student loan re-enbertment. He has also been irresponsible on paying the loan back. I have been paying the loan back but I have been trying to get some reimbursement back form the school with no responds because of the hippa laws. Is there anything that I can legal do about this? It started in 2005. I did contact the General Attorneys office of Minnesota about this and they also said because Of the hippa laws I was not able to do anything. I just do not get it. I am the one legally responsible for the repayment of the loan but I have not rights on the dispute of the full payment of his tuition at the beginning of the two year course.

Answer

Unfortunately co-signing does not mean you get full access to your son's records and loan information. All co-signing does is insure that you can be forced to pay when your son defaults. Your son is the one who needs to obtain this information for you. If possible your son needs to check with the lender and the school if he can give permission to sign an authorization to release the information for you to have full access of what you need. This is dependent on the school and/or the lender.

Is there a time limit for any action to be done. I had been trying to get my son to take care of this, but time has been passing by and his is still being irresponsible.

I am assuming this is a government student loan, if so there is no statute of limitations on enforcement.
