I was served a 3day notice and an unlawful detainer the same day. I currently am 12day late on paying the rent for febuary, what are my rights, and is a motion for quash good to do for me...

Answer

The unlawful detainer cannot be served until after the 3 day notice. It can be re-served once the 3 days has expired. You should answer the unlawful detainer by saying indicating the 3 day notice period has not expired, and ask for dismissal of the case. You should submit a motion to dismiss along with your answer.
