Question

My employer just informed some, not all, of our salaried/exempt employees that all exempt employee's pay has been reduced by 10%. It is the 12th day of the pay period and it was not provided in writing. We were instructed that we would be allowed one day off per pay period for compensation, but would be required to turn in a "make up" time card showing 8 hours worked for the day off, as the company intends to report and pay us for 80 total hours per pay period when we have worked only 72. No explanation has been given to what effect on retirement, vacation value and accrual, or benefits this would have. What happens if someone is injured off the job on the day they filled out a "make up" time card? This seems very fishing. Should this be questioned and to whom should the complaint be taken.

Absent a written contract to the contrary you are at will employees and exempt employees must work whatever hours the employer wants. Now, as far as making up time cards, this is a violation of the Fair Labor Standards Act and your concern about someone getting injured during these "fake hours" is valid, since the company could use those records to claim you did not get hurt at work.

As far as the reduction in pay, they can reduce your pay for future time worked, but not for time already worked and the notice does not necessarily have to be in writing as long as you were notified.

You do need to file a complaint here about the false time cards to the US Department of Labor's wage and hour division. But as far as the cut in pay for future time worked, there is not much you can do about that as an at will employee.
