Question
I am a pro se defendant in a case against an out of state (georgia) entity. They served me with a notice of deposition fir week of 2/16. Since I am a party they did not subpoena me. I asked for a continuance (first time) and told them to let me know by last friday - there has been no response. Do I need to do anything - file a motion for continueance? or do they need to take action - motion to compel?

Thank you for contacting Just Answer. I look forward to assisting you.
While we write back and forth, please keep in mind that I do not know what you already know or don't know, or with what you need help, unless you tell me.
There can be a delay of an hour or more in between my answers because I may be researching the answer to your question, helping other customers, or taking a break. If we are writing late at night, I may have to go to sleep and resume helping you the following morning.

For more information about your matter,
you should consult with an attorney of your choice in a traditional face-to-face or telephonic meeting.
Call the attorney for the other side and ask if they received your request for a postponement of the deposition. These things can get lost on a lawyer's desk. You can negotiate a new date for the depo on the phone, then and there, if you wish.
Depositions are scheduled by the parties; the court is rarely involved with them. Motions and such are not appropriate, especially since this is a civil, not a criminal, action.
