Question

After a judge has heard a divorce trial how long should it be before he renders a verdict? The guardian ad litem supports joint custody, with the father having physical custody. The trial was in Oct and still no verdict. Everyone wants to move on, but this seems to be hovering over our heads until we get an answer. It also doesn't help that there has been no child support in over 2 years. The state is Missouri.

We keep asking our lawyer, but his response is that it takes time and the don't want to bug the judge because then he might not find in our favor. This separation and divorce has been going on for over 2years. My son has had custody of his daughter the whole time. Her mother has paid no child support at all. Her lawyer's scheme was to ask for a speedy trial so there would be no need to set temp child support. The judge agreed. Then came all the continuances, about 4 in all, which the judge granted. So a year later they finally went to trial, in Oct 08, the guardian ad litem has sided with my son, but it seems like the judge is taking forever to render a verdict. My son's lawyer has said he's seen it take up to a year to get a verdict. That's riduclous. We asked his lawyer if he would go back and ask for temp child support until a decision is made, but he said that would be like slapping the judge in the face and to just wait it out. Easy for them to say, they all make great incomes. We have already paid out $12000 for his lawyer and we tapped out. Not to mention the money we have paid the guardian ad litem. This sure seems like a racket to me. I'm so disappointed in the legal system at this point!!!!

I understand your frustration. This should not take a year nor even months. Consider directing your lawyer to request temporary support. It should not be an affront to the judge that you son needs money to provide for his daughters needs.

I already asked him to do that and he's the one that said it would insult the judge and could sway his decision, so he's not going to do it.

 

I even tried calling the court myself and that didn't work.

 

Does anyone on here know anything about judge brian wimes and how long he usually takes to render a decision?

We cannot directly comment on a particular judge.


Your son can direct his attorney to file the motion. Your son is the client. His attorney needs to follow his instruction.

Not to be negative, but your answers are all "stock" answers and don't always apply to real live situations.

 

I work for the Air Force, and I thought we had the ticket on red tape, but I was wrong. My son's divorce and child custody situation has been going on for 2 years. And the the court has not awarded him temp child support. Both are in the military, and they have been of no help. I am beginning to believe this is a case of discrimination.

 

I believe the only ones that are winning in this situation are the lawyers, who are collecting big bucks.

 

Sorry that's just how I feel.

You are correct that it is improper for this to be going on for two years wihout any child support. That is why I am saying that your son can direct what his attorney does. Your son is the client. He needs to tell the attorney to do his job and petition for support.
