i have filed quit claim deed on property which was listed in my husbands name. he died 01-10-09 and i havent yet filed or probated his will yet. what do i do and how much will this cost. i want to know before paying off this house and property.

Answer

You must hire an attoreny to file any probate in FL. It will cost at least $5000 if there is property that needs to have names changed for ownership. But if your husband already signed a deed to give the house to you before he passed and you filed it, it does not need to pass by probate.

Yes if he signed a deed to give you the property you just need to have it filed with the court deed records and you are the owner, there is no need to probate.
