Question

I am divorced and my ex-husband and I each claim one child of our two children. In claiming the particular child as a dependent, do you also claim all of the medical and other expenses connected to that child or do you simply claim the child as a dependent and medical expenses are claimed all together in another category?

Answer

You can claim all the medical and other expenses that you pay for the child and for yourself as an itemize deduction.Note that medical expenses that are over 7.5% of your adjusted gross income is deducted as part of itemized deduction.

I need to clarify some things. My husband is listed in the divorce agreement as claiming one of our two children as a dependent. Both children live with me and are on a visitation plan with him. I pay for all medical expenses for both children. If I pay for their medical insurance plus any additional medical expenses, does he still get to claim those expenses that are attached to the particular child he is claiming as a dependent, even if he has not actually paid those medical expenses?

Accepted Answer

You can claim the medical expenses that you pay for the child even if your ex claims the child.

A child of divorced or separated parents is treated as the dependent of both parents for purposes of deducting medical expenses
