The exclusionary rule is a necessary part of constitutional law. The Fourth Amendment's protections from unreasonable searches and seizures would mean very little if police officers or government agents could easily get around that civil right simply because they did, in fact, find evidence of illegal conduct. Without the exclusionary rule there would be no protections from police misconduct. There must be a great deal of motivation for police to violate the Fourth Amendment, particularly when they can convince themselves that the public good demands it. One cannot deny that it is important to stop crime and prevent crimes from occurring. However, it would be a crime to allow officer of the law to avoid the law. The civil rights granted to Americans under the Constitution are only able to enforce the protections of the law to all Americans because all Americans are subject to its protections. The exclusionary rule is an important foundation of American constitutional and criminal law and without it the nation and its citizens risk the loss of all civil rights.
