Question

My possessions were put into storage after I failed to return a U-haul that was in my step fathers name. I was told that when the late fees were paid, I would get my 'stuff' back. Then I was informed that the storage was costing me another $100 per month and since I am unemployed was unable to pay this and they sold my 'things'. Can they do that?

I've tried talking to them. Explaining the circumstances and that the truck was in my dad's name and that at the time my 'stuff' was put in storage I was not made aware that there would be a monthly bill.

I live in Lacona, Iowa, but this issue occured in Cleveland, Ohio. And I've tried taking to them , stating that first of all my name was not on the rental contract and second that I was not notified when my 'stuff' was put into storage that there was going to be a monthly fee. I was told that when the balance on the truck was paid that I would get my things back.

That being said...

They are allowed to hold the items until the balance has been paid. If it is not paid, they can sell the items to cover the balance and then sue for the difference between the balance and the sale price of the items.

However, I cannot find any basis for them to charge you storage. I would demand, in writing, that they provide you with the authority for that. It may be in the contract, but there is nothing in the law that allows them to do that.

You can, but you also have to sue the renter of the truck who failed to pay the bill.

My father was never personally notified of the balance on the truck. For some reason they put all the information in my name, even though my name was not on the contract and I was not driving the truck. Now what?

Answer

It is not an issue. Someone knew there was a balance when they turned the truck in. If the information is in your name. they can sell the property. You can sue them for it, but you will have a difficult time.
